The 2023 Montana Legislative session (the most recent session) saw an onslaught of attacks on the 2S-LGBTQIA+ community. From banning gender-affirming care to targeting drag performances, during the 2023 session many legislators tried to effectively penalize the experience of being 2S-LGBTQIA+. The ACLU of Montana is committed to protecting the rights of queer and trans people in all aspects of life and is prepared to challenge any legislation singling out queer Montanans for  discriminatory treatment.

During the 2025 Montana legislative session, we tracked the following legislation that could impact 2S-LGBTQIA+ rights:

 HB 121, an anti-trans bathroom bill, stigmatizing and discriminating against transgender, intersex and gender nonconforming Montanans, while raising serious questions about privacy, safety and enforceability. This bill was signed into law, and the ACLU of Montana is suing to prevent it from going into effectACLU of Montana OPPOSED this bill.

 HB 300, an anti-trans sports bill, banning transgender student athletes from participating in sports as their authentic selves. Unfortunately, this bill passed was passed by the Montana legislature and signed into law by the governor. ACLU of Montana OPPOSED this bill.

 HB 400, an anti-trans education bill, allowing educators and other public employees to misgender or use the wrong name when referring to transgender students. Unfortunately, this bill passed was passed by the Montana legislature and signed into law by the governor. ACLU of Montana OPPOSED this bill.

HB 446, an anti-trans bathroom bill, revising indecent exposure laws to persecute trans people in restrooms and changing rooms. Unfortunately, this bill passed was passed by the Montana legislature and signed into law by the governor.. ACLU of Montana OPPOSED this bill.

HB 675, an anti-2S-LGBTQIA+ censorship bill, criminalizing drag performances and mischaracterizing them as inherently sexual. This bill did not make it through the 2025 legislative session, meaning it will not become law. ACLU of Montana OPPOSED this bill.

HB 682, an anti-trans healthcare bill, placing excessive liability on medical providers and incorrectly casting gender-affirming care as harmful and fradulent. Unfortunately, this bill passed was passed by the Montana legislature and signed into law by the governor. ACLU of Montana OPPOSED this bill.

 SB 164, an anti-trans healthcare ban, criminalizing healthcare for transgender youth, despite the fact that every major medical association in America endorses the provision of this type of care. This bill did not make it through the 2025 legislative session, meaning it will not become law. ACLU of Montana OPPOSED this bill.

 SB 218, an anti-trans healthcare bill, creating excessive liability requirements around gender-affirming care, even though most medical care has no such requirements. Unfortunately, this bill passed was passed by the Montana legislature and signed into law by the governor. ACLU of Montana OPPOSESD this bill.

SB 437, an anti-trans bill, would narrowly and restrictively redefine sex in an attempt to legislate transgender and nonbinary people out of existence. As of 5/22/2025, this bill has passed both the Montana House and Senate, but has not yet been signed into law. ACLU of Montana OPPOSES this bill.

 HJ10, an anti-trans resolution, urging the United States Senate and Congress to restrict the ability of transgender student athletes to participate in sports. Unfortunately, this resolution passed in both the Montana House and Senate. ACLU of Montana OPPOSED this resolution.
