Montana’s public defense system is buckling under pressure from years of underfunding and a bloated criminal legal system.

The State issued an emergency rule stating that it will not comply with the Court’s order to return to the 2017 standard for changing the gender marker on birth certificates. The following statement was issued in response by the ACLU of MT the ACLU LGBTQ & HIV Project, and Nixon Peabody LLC.

Nearly one month after a state district court granted a preliminary injunction in Marquez v. State of Montana, the State is still refusing to comply.

Today a state district court granted a preliminary injunction in Marquez v. State of Montana, holding that a law passed by the 2021 Montana Legislature likely violates the constitutional rights of transgender Montanans.

A Montana court blocked two state laws that hinder Native American participation in the state’s electoral process.
