Case Update, April 14, 2026: The Montana Supreme Court upheld a District Court order temporarily preventing the State of Montana from enforcing policies that bar transgender people from obtaining accurate sex designations on their birth certificates and driver’s licenses. This means that transgender Montanans will continue to have access to accurate and usable identity documents while the case proceeds.

Case Update: Thursday, April 9, 2026. A Montana District Court ordered that the Montana Department of Justice pay petitioners $73,371.13 in attorney fees and costs.

This case challenges HB 121, a newly enacted law which stigmatizes and discriminates against transgender, intersex, and gender-nonconforming Montanans by effectively barring access public facilities and private nonprofit domestic violence programs

The Montana Supreme Court ruled that SB 99, a 2023 Montana law that categorically bans life-saving gender-affirming care for transgender youth, is unconstitutional under the Montana state constitution’s privacy clause.
