In November 2007, the ACLU of Montana and a medical marijuana advocacy group, Patients and Families United, filed an amicus in this case before the Montana Supreme Court. We claimed that a probationary condition preventing a person from using medical marijuana violated Montana sentencing laws and was unconstitutional. On October 28, 2008, the Montana Supreme Court agreed with our amicus position and that of the Appellant, vacated the sentence and remanded the case for resentencing.
