The Legal Program handles cases that involve infringements upon constitutional rights and civil liberties. We represent individuals or classes of individuals whose cases will either serve to create new precedent or will result in general system-wide reform in favor of protecting and defending civil liberties.

In other situations, we may not file a lawsuit, but may write letters calling for changes or reforms.

Soto-Lopez v. Gallatin County

Luis Soto-Lopez was wrongfully jailed at the Gallatin County Detention Center pursuant to an Immigration and Customs Enforcement Hold (also called a “detainer”), despite his ability to post bond for a misdemeanor.

Ramon v. Lincoln County

Agustin Ramon was illegally held on an ICE detainer in Lincoln County. When he tried to pay his bond to secure his release from jail pending trial, he was informed that because of an ICE detainer, the jail could not release him.

Eleanor Maloney v. Yellowstone County

Eleanor Andersen Maloney, a transgender woman, was denied all gender-affirming healthcare under Yellowstone County’s Group Health Benefit Plan while employed as a Senior Deputy County Attorney.

Herrera v. Wyoming

We filed an Amicus Brief on behalf of Clayvin Herrera, a Crow tribal member, who was exercising his treaty rights when he hunted elk in the Big Horn National Forest in Wyoming in January 2014.
